Using or accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines communicated herein or posted on the Platform. You should not use or access the Platform unless you accept these Terms.
Acceptance of Terms
By your continued use of the CLOTHINGABC (https://clothingabc.com/) Platform, you are expressly declaring your agreement to be bound by these Terms and terms which may be modified by us at any time without prior notice. You have the obligation to periodically review these Terms to make sure they have not changed. Registration and User Accounts
You will be asked to create an account with the Platform in order to use specific features of the Platform. To open an account, you must be 18 years old or older and must be legally allowed to sign binding agreements, according to Ghanaian law. Marketplace Role and Limitation of Liability
CLOTHINGABC is an online marketplace designed to connect sellers and buyers and act as a conduit to transact with one another. We are not owners, sellers, or inspectors of goods that were listed by sellers. We do not actually deal with the buyers and their sellers. This is not in our control, and we make no promises, warranties, or guarantees of the quality, safety, morality, or legality of any aspect of the things listed, the veracity or accuracy of these listings, the seller’s ability to sell, or the buyer’s ability to purchase items.
We do not assume any liability or responsibility to you or to any other person in relation to the direct or indirect, incidental, special, consequential, or exemplary damages (either actual or to be anticipated), including but not limited to, any loss of profits, goodwill, use, data, or other forms of intangible loss. The Users do all transactions at their own risk.
User Responsibilities and Unacceptable Conduct
You shall not use the Platform to do anything unlawful or in conflict with these Terms or all applicable laws and regulations in Ghana. You are not permitted to:
(a) Use our platform to upload or post any unlawful, threatening, harmful, abusive, defamatory, obscene, or otherwise offensive content;
(b) try to deceive or mislead us or any other party, or to make false representations about yourself or your products;
(c) Infringe any third-party intellectual property rights;
(d) interfere with the proper operation of the Platform or attempt to gain unauthorized access to any part of the Platform;
(e) distribute spam, viruses, or any other harmful computer code;
(f) collect or harvest personally identifiable information about. Specifically, sellers will commit to providing truthful information on descriptions, prices (in Ghana Cedis – GHS), and availability of all listed products, as well as delivery or delivery time of orders placed.
Purchases, Payments & Pricing
The prices on the Platform are in Ghana Cedis (GHS). Buyers agree to pay the proposed price of the products bought, excluding delivery charges and taxes. clothingabc.com has third-party secure publishers where its transactions are conducted. When you make a purchase, you accept the terms and conditions of the following payment processors: CLOTHINGABC is at liberty to hold payments in escrow until the shipment confirmation to be on the same level of protection as the rest of the markets.
Delivery
Sellers will have the responsibility of delivering goods to buyers within the respective duration as agreed. It is the responsibility of the buyers to give correct shipping information. Buyers must take responsibility for any delay, damages, and losses associated with shipping incurred in the course of shipping by third-party carriers by clothingabc.com. Shipping issues must be solved primarily between the buyer and the seller.
Returns, Refunds, and Cancellations
Return and refund, and cancellation policies are, to whatever degree them is offered, mainly at the discretion of individual sellers and may be shown on their individual product pages or author profiles. A consumer is advised to read these policies prior to his or her purchase. Although CLOTHINGABC may provide help with dispute resolution with regard to some of the problems, the last word on the issue of accepting returns or refunding buyers lies with the seller. Dispute Resolution
In case of conflict arising between a buyer and a seller, we welcome the communication directly between them with the aim of resolving the conflict in a friendly manner. In case the direct resolution does not work, the Users can raise the issue to the customer support of CLOTHINGABC, which can act as a mediator of the dispute. Any controversies or disputes in relation to or arising out of these Terms or collapsed use of the Platform will be settled in Ghanaian courts.
Intellectual Property
All the materials on the Platform, such as text, graphics, logo, images, and software, are owned by the content providers and are covered by Ghanaian and international copyright laws. Their accounts allow clothingabc.com an exclusive, global, royalty-free license to use, reproduce, revise, and publish any materials (e.g., product photos, reviews, and descriptions) that they upload to the Platform as much as is required to set it up and promote it.
Terms Changes
The Terms may be amended at any time. Any modifications will take effect once the amended Terms are put in place on the Platform. By using the Platform subsequent to any such changes, you will be deemed to have agreed and accepted the new Terms.
Termination
You agree that we reserve the right to terminate or suspend your account, in our sole discretion, at any time and without prior notice, terminate or suspend your account and your access to the Platform.
Governing Law
With the exception of any choice or conflict of law clauses, these terms shall be interpreted and controlled by the laws of the Republic of Ghana.
